General Terms and Conditions of Reservation – Malibu Surf House
These General Terms and Conditions, together with our Privacy Policy and any information provided prior to booking, govern your contract with Golden Coast Lodge SARL, operator of Malibu Surf House, located in Tamraght, Morocco.

By confirming a reservation, the lead guest (the person making the booking) agrees to these terms on their own behalf and on behalf of all listed participants, and confirms that they have the authority to do so.

1. Contract and Reservation
The reservation contract is concluded between the client and Golden Coast Lodge SARL, operator of Malibu Surf House.
No contract exists until the booking form has been completed and the required deposit has been received.
For group bookings, the lead guest is responsible for ensuring that all participants are aware of and accept these terms and conditions.
The establishment reserves the right to refuse any reservation, at its discretion, without obligation to provide justification.
It is the client's responsibility to carefully check the details of their reservation and to inform us promptly of any errors.

2. Prices
Prices are indicated in euros (€) for guidance purposes, to facilitate understanding for our international clientele.
The Bed & Breakfast rate is calculated per night, unless otherwise stated (special offers, privatization, organized stays).
Once a reservation is confirmed, prices are firm and final and may not be modified, except in exceptional circumstances beyond our control.
Additional services (meals, activities, excursions, transfers, etc.) are not included in the accommodation price unless explicitly stated otherwise.

3. Payment and Credit Card Guarantee
A 10% deposit of the total stay amount is required at the time of booking to confirm the reservation.
The remaining balance must be paid in cash (Moroccan dirhams or euros) upon arrival at the establishment.
For online bookings, the client's credit card details are collected and securely stored as a guarantee.
By confirming the reservation, the client expressly authorizes Malibu Surf House to charge the amounts due in the event of:
late cancellation,
no-show,
early departure,
or unpaid charges (extras, damages, etc.),
in accordance with these terms and conditions.

4. Cancellation Policy
All cancellations must be made in writing (by email) to: contact@malibusurfhouse.com

Depending on the cancellation date, the following charges will apply and will be charged accordingly, in accordance with these terms and conditions:

For cancellations made more than 30 days before the arrival date, no charges will apply.

For cancellations made between 30 and 16 days before the arrival date, charges equivalent to 50% of the total stay amount will apply.

For cancellations made between 15 and 8 days before the arrival date, charges equivalent to 75% of the total stay amount will apply.

For cancellations made less than 8 days before the arrival date, charges equivalent to 100% of the total stay amount will apply.

In the event of a no-show, the full stay will be charged.

Any shortened stay or unused services after arrival are non-refundable.

The applicable charges will be charged to the credit card provided at the time of booking.

5. Surf Guiding and Activities
Surf guiding consists of accompanying guests to local surf spots and providing general advice, but does not constitute a surf lesson. Participants must be autonomous and have sufficient surfing ability.
Guides are not responsible for accidents or injuries occurring during surfing or any other activity.
In the event of unsuitable surf conditions, alternative activities may be offered, subject to availability and additional charges.

6. Check-in, Check-out and House Rules
Upon arrival, a valid ID document may be requested in accordance with Moroccan law.
Guests agree to comply with the house rules, particularly regarding peace and quiet, safety, and respect for other guests.
Any inappropriate, dangerous, or disruptive behavior may result in immediate termination of the stay, without refund or compensation.

7. Activities and Services Offered
Malibu Surf House offers various activities such as surf, yoga, excursions, and local experiences.
Some activities are provided by independent partner service providers.
In such cases, the establishment acts solely as an intermediary and cannot be held responsible for any accident, injury, or damage occurring during these activities.
Participation in activities is entirely at the client's own risk.

8. Liability
Photos and descriptions displayed on the website are for illustrative purposes only and are not contractually binding.
Malibu Surf House cannot be held liable in cases of force majeure (weather conditions, administrative decisions, strikes, service outages, health crises, etc.).
In the event of early departure initiated by the client, no refund may be claimed.

9. Taxes and On-site Payment
On-site payments are made in Moroccan dirhams (MAD), based on the exchange rate in effect at the time of payment.
Any tourist taxes must be paid directly on site.

10. Data Protection
Personal data collected is used exclusively for reservation management and communication with the client.
Such data is only shared with technical service providers necessary for the proper operation of the booking system and is processed in a confidential and secure manner.

11. Force Majeure
In the event of exceptional and unforeseeable circumstances preventing the stay from taking place, the reservation may be postponed where possible, without obligation to provide a refund.

12. Applicable Law and Disputes
These General Terms and Conditions of Reservation are governed by Moroccan law.
In the event of a dispute, the parties will endeavor to reach an amicable solution.
Failing this, the courts of Agadir shall have exclusive jurisdiction.

13. Complaints
Any issue encountered during the stay must be reported immediately on site, in order to allow for prompt resolution.
Any unresolved complaint must be submitted in writing within 28 days after departure.
